  • Data centre facilities: Our platform runs on servers owned and operated by WebSMS, housed in secure New Zealand data centres. The facilities provide physical hosting (power, space, and connectivity) only and have no access to your data

These providers are contractually obligated to protect your information and can only use it as directed by us to provide their services.

6. Disclosure for Legal and Compliance Purposes

While we are committed to protecting your privacy, we reserve the right to disclose your information in the following circumstances:

Terms of Service Violations

If your account is found to be in breach of our Terms of Service (including but not limited to sending spam, phishing, or fraudulent messages), we reserve the right to share your account information, message logs, and related data with:

  • Law enforcement and government authorities: Including New Zealand Police, the Department of Internal Affairs, and other relevant regulatory bodies
  • Telecommunications carriers: Our upstream providers and network partners who may be affected by or investigating the abuse
  • Industry groups: Including the New Zealand Telecommunications Forum (TCF) spam reporting initiatives and other industry bodies working to combat SMS fraud and abuse
  • Other affected parties: Organisations whose brand or identity was misused in fraudulent messages (e.g., banks, government agencies)

We may also disclose your information when:

  • Required by law, court order, or legal process
  • Necessary to protect the rights, property, or safety of WebSMS, our users, or the public
  • Needed to investigate or prevent fraud, security issues, or technical problems
  • Required to comply with telecommunications regulations

As a telecommunications service provider, WebSMS is subject to applicable New Zealand telecommunications and lawful-access requirements, including obligations relating to lawful interception and assistance to authorised agencies.

All customer data and message content — including backups — is stored and processed on servers owned and operated by WebSMS, located in New Zealand. We do not use overseas cloud providers to store or process your data, so your information remains subject to New Zealand law.

WebSMS handles telecommunications information in accordance with applicable New Zealand privacy requirements, including the Privacy Act 2020 and, where applicable, the Telecommunications Information Privacy Code 2020.

The only circumstance in which data leaves New Zealand is message delivery itself: when you send a message to an overseas number, the message content and destination number are necessarily passed to the international carrier networks required to deliver it.

We may update this privacy policy from time to time. We will notify you of any significant changes by email or through our platform. The "Effective Date" at the top indicates when this policy was last revised.
